United States Constitution
Congress shall have the power:
The owner of copyright has the exclusive rights (17 U.S. code § 106) to do and to authorize any of the following:
1. The right to make copies
2. The right to distribute copies
3. The right to public performance
4. The right to prepare derivative works
ClearPlay is not being
sued by the studios
1. ClearPlay does not make copies.
2. We don't distribute copies.
3. We don't publicly perform copies.
4. We don't make derivative works.
When ClearPlay first introduced movie filtering, there was debate over whether filtering infringed the exclusive rights of the copyright holder to prepare "derivative works."
The Family Movie Act, passed by Congress in 2005, provided clarity to this question. It established that if the filtering did not create a new copy, then the filtering was not in violation of the right to prepare derivative works.
The Family Movie Act did not legalize unauthorized copying of movies; and rightly so. ClearPlay is a strong believer that the copyrights secured by the Constitution provide the incentives and environment in which creativity can (and does) flourish.
Existing law, as supported by the Constitution, secures both copyright and filtering. ClearPlay respects this. It gives us all security in knowing we can enjoy high-quality entertainment, and have the liberty to filter for ourselves and our posterity, watching movies together as a family.
